Article 4 of the EU AI Act is 58 words long. It requires that providers and deployers of AI systems ensure "a sufficient level of AI literacy" among their staff and anyone else dealing with AI systems on their behalf. It has been legally binding since February 2, 2025. Enforcement by national market surveillance authorities begins August 2, 2026, five months from now.
For recruiters, this is not a distant compliance item. It is a current obligation with a fast-approaching enforcement date, and it intersects with a second, larger set of requirements: the EU AI Act classifies AI systems used in recruitment and hiring as high-risk, triggering strict obligations around documentation, human oversight, bias testing, and transparency that also take effect in August 2026.
This article explains what Article 4 requires, how the broader high-risk classification affects recruitment AI, and what you should be doing now, not in July.
What Article 4 actually says
The full text of Article 4:
Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used.
Three things matter in that text for recruiters:
"Deployers": that is you. If your recruitment firm uses any AI system (an ATS with AI-powered screening, a chatbot that interacts with candidates, an AI tool that helps write job descriptions, or even ChatGPT to draft candidate briefings), you are a deployer under the EU AI Act.
"Staff and other persons dealing with the operation and use": this is broader than your technical team. The European Commission has clarified that "other persons" includes contractors, service providers, and even clients who use AI systems on your behalf. If your consultants use AI tools in their daily work, they fall within scope.
"Taking into account ... the context the AI systems are to be used in": AI literacy is not one-size-fits-all. A recruiter using AI to screen candidates for a financial services role operates in a different risk context than one using AI to draft social media posts. The regulation explicitly requires you to calibrate literacy requirements to context.
Article 4 is already in force. Enforcement is what is new
A common misconception: Article 4 "takes effect" in August 2026. This is wrong. The obligation to ensure AI literacy has been legally binding since February 2, 2025. What begins in August 2026 is supervision and enforcement by national authorities.
This distinction matters because the Commission has indicated that a lack of AI literacy will be treated as an aggravating factor in enforcement actions for other EU AI Act violations. If your AI screening tool produces a biased outcome and an investigation reveals your team had no AI literacy training, regulators will not treat that as two separate issues. They will treat the literacy failure as evidence that the bias failure was foreseeable and preventable.
Article 4 does not carry its own direct fine. The penalties under the EU AI Act are tiered based on the nature of the violation: up to EUR 35 million or 7% of global annual turnover for prohibited practices, and up to EUR 15 million or 3% for other violations including high-risk system non-compliance. The absence of a standalone Article 4 penalty does not mean the obligation is toothless. It means the consequence of failing to meet it is that every other penalty becomes harder to defend against.

Recruitment AI is classified as high-risk
Article 4's AI literacy requirement applies to all AI systems. But for recruiters, there is a second layer of regulation that is equally important: the EU AI Act classifies AI systems used in employment, recruitment, and HR decisions as high-risk.
This means any AI tool that is used to screen CVs, rank candidates, evaluate interview responses, score assessments, or recommend hires is subject to the full set of high-risk obligations. These include:
Risk management: You must identify, assess, and mitigate risks throughout the AI system's lifecycle, not just at deployment, but continuously.
Data governance: The datasets used to train or operate the AI system must be representative, relevant, and tested for bias.
Technical documentation: You must maintain detailed records of how the system works, its intended purpose, and its known limitations.
Human oversight: The system must be designed and used in a way that allows effective human intervention. Persons responsible for oversight must be properly trained and qualified, and ongoing training is required to maintain compliance over time.
Transparency: Candidates must be informed when AI is used in the recruitment process. Employers have a separate duty to inform affected workers before deploying high-risk AI in the workplace.
Logging and monitoring: Automatically generated logs must be retained for at least six months. You must monitor the system to detect discrimination or adverse impacts, with prompt suspension and notification obligations where issues arise.
The high-risk obligations were scheduled to take full effect in August 2026. The European Commission's Digital Omnibus package proposes making some deadlines conditional on the availability of harmonized technical standards, potentially delaying certain requirements to late 2027 or 2028. However, Article 4's AI literacy requirement is not affected by the Omnibus proposals. It is already in force and will remain so regardless of any timeline adjustments to the high-risk provisions.
This applies even if you are outside the EU
The EU AI Act has extraterritorial reach. If your AI system's outputs are used within the EU (for example, if you screen, rank, or evaluate EU-based candidates, even from a non-EU office), the Act applies to you.
A recruitment firm based in Oslo using an AI screening tool for candidates applying to roles in Stockholm, Copenhagen, or Helsinki is within scope. A firm based in London recruiting for EU positions is within scope. A firm based in New York using a global ATS with AI features that processes EU candidate data is potentially within scope.
The logic mirrors GDPR: it is not where you are that matters, but where the AI's effects are felt. For Norwegian recruiters, this is straightforward. Norway, as an EEA member, is transposing the EU AI Act into national law through the KI-forordningen.
The practical implication: if you operate across Nordic borders, placing candidates in Sweden, Denmark, Finland, or other EU member states, you cannot treat AI compliance as a single-country issue. Your AI literacy program and your vendor compliance documentation must account for every jurisdiction where your AI tools influence hiring outcomes.
What "sufficient AI literacy" actually requires in a recruitment context
The Commission has stated that simply asking staff to read an AI system's instructions for use "may be ineffective and insufficient" to meet Article 4. There is no prescriptive curriculum; the regulation gives organizations flexibility to define their own approach. But the Commission's guidance makes clear that the following baseline elements are expected:
General AI understanding. Staff should know what AI is, how it works at a functional level, which AI systems are in use within the organization, and the associated opportunities and risks.
Organizational role clarity. People should understand whether the organization develops AI systems or uses systems supplied by others, because the obligations differ.
Risk identification. Staff should understand the specific risks associated with the AI systems they use. For recruiters, this means understanding bias risk in screening algorithms, hallucination risk in AI-generated candidate summaries, and privacy risk in tools that process personal data.
Proportionate depth. Not everyone needs the same level of literacy. A recruiter who makes final hiring recommendations based on AI-generated candidate rankings needs deeper understanding than an administrator who uses AI for scheduling. The regulation requires you to calibrate.
For recruiters specifically, "sufficient AI literacy" means your team understands what the AI tools in your workflow actually do, where they can fail, what data enters them, and when human judgment must override algorithmic output. Only 8% of Norwegian HR departments believe they currently have sufficient AI competence (PwC Norway, 2024). The gap between the regulatory requirement and the market reality is substantial.
The emotion recognition ban is already active
One prohibition is already enforced and directly affects recruitment: as of February 2, 2025, AI systems that perform emotion recognition in workplace and educational settings are banned. This includes AI tools that analyze facial expressions, vocal tone, or body language during video interviews to assess candidates' emotional states, personality, or cultural fit.
If your video interview platform has features that claim to evaluate "soft skills" through behavioral analysis of video responses, check whether it uses emotion recognition technology. If it does, that feature must be disabled. It is not a high-risk system requiring compliance measures. It is a prohibited system that cannot be used at all. The penalty for prohibited AI practices is up to EUR 35 million or 7% of global turnover.
What to do now, not in July
Five months is not a long time to achieve compliance, but it is enough if you start now. Here is the practical sequence:
1. Inventory your AI systems
List every AI tool your organization uses in the recruitment process. This includes the obvious ones (ATS with AI screening, AI interview platforms, AI assessment tools) and the less obvious ones: ChatGPT or Claude used to draft job descriptions, AI tools used to source candidates, AI-powered reference checking platforms.
For each system, determine whether it influences hiring decisions. If it does (if it screens, ranks, scores, recommends, or evaluates candidates in any way), it is likely high-risk under the EU AI Act and subject to the full set of obligations.
2. Assess your team's current AI literacy
Before designing training, measure where your people are. Self-reported competence is unreliable. The more people use AI, the more they overestimate their abilities (Aalto University, 2026). Use scenario-based assessment that tests whether your team can identify when AI output is unreliable, when data should not enter an AI system, and when human judgment should override an algorithmic recommendation.

3. Design role-appropriate training
Map literacy requirements to the specific AI tools and contexts each role encounters. A consultant who uses AI to generate candidate briefings needs training on hallucination detection and source verification. A data analyst who builds candidate scoring models needs training on bias identification and data governance. An account manager who presents AI-generated reports to clients needs training on transparency and disclosure obligations.
The Commission emphasizes that AI literacy "is most effectively developed through direct, hands-on use", not through passive lectures or e-learning modules. Design training around realistic scenarios from your actual recruitment workflows.
4. Engage your AI vendors
Ask your AI tool providers direct questions: Are they aware of the EU AI Act? Are they preparing for CE marking and high-risk compliance? Can they provide documentation on how their systems work, what data they use, and what bias testing they have conducted? Have they registered (or plan to register) their high-risk systems in the EU database? Can they share their conformity assessment results?
A vendor that cannot answer these questions is a compliance risk, because under the Act, both the provider and the deployer have obligations. The provider carries the primary responsibility to ensure the AI tool meets technical requirements, but as the deployer, you are responsible for using it correctly, maintaining human oversight, and not ignoring issues. If you deploy a non-compliant high-risk system, "we relied on our vendor" is not a defense.
Review your vendor contracts. Ensure they include provisions for compliance documentation, bias audit results, incident notification, and ongoing technical support. If your vendor operates outside the EU, confirm whether they have appointed an authorized representative within the EU as required for non-EU providers of AI systems used in the EU market.
5. Document everything
Record your AI system inventory, literacy assessment results, training programs, participation rates, and any actions taken to address identified gaps. This documentation is your compliance evidence. When national market surveillance authorities begin enforcement in August 2026, the first thing they will ask for is evidence that you took measures to ensure AI literacy. If you cannot show documentation, you cannot demonstrate compliance, regardless of what you actually did.

The compliance opportunity
There is a version of this article that frames the EU AI Act purely as a compliance burden. That would be accurate but incomplete. The more useful framing for recruiters is this: the regulation creates a market signal that you can own or ignore.
When August 2026 arrives, every recruitment firm operating in the EU will need to demonstrate AI literacy. The firms that can show documented AI readiness assessment, structured training programs, and ongoing measurement will have a compliance advantage. The firms that treated AI literacy as a last-minute checkbox will be scrambling.
But the real opportunity is commercial, not just regulatory. Clients are increasingly asking their recruitment partners how they use AI, how they ensure quality, and how they manage risk. A recruitment firm that can say "we assess every consultant for AI readiness and maintain documented compliance with Article 4" is making a differentiation claim that most competitors cannot match.
The regulation is coming regardless. The question is whether it arrives as a cost or as an advantage. Five months is enough time to make it the latter.
